Documents to Check Before Buying an Under-Construction Flat in Pune

Most problems buyers face later can be caught by reading a handful of documents before paying a large amount. Use this checklist when you evaluate any under-construction project.
1. MahaRERA Registration Certificate: Confirm the registration number on the official portal. Check the promoter name, the registered completion date and whether the registration is active. Registration is required before a project can be advertised or sold.
2. Title Report and Land Records: The title report, prepared by an advocate, describes who owns the land, any mortgages or disputes, and the chain of ownership. Ask for the 7/12 extract or property card and consider a review by your own advocate.
3. Commencement Certificate: Issued by the planning authority such as PMC, PCMC or PMRDA, it allows construction up to specified floors. Make sure the floors of the tower you are buying are covered.
4. Sanctioned Plans and Floor Plan: Compare the floor plan in the agreement with the sanctioned plan, including room sizes, carpet area and the location of your unit.
5. Draft Agreement for Sale: The agreement should state carpet area, price, payment schedule, possession date, the amenities promised and the consequences of delay. Under RERA, the standard format is prescribed by the state, so be wary of clauses that depart from it.
6. Payment Schedule and Receipts: Payments should be linked to construction milestones. Pay through traceable banking channels and keep a receipt for every payment.
7. Bank Approvals: If you need a home loan, check which banks have approved the project. Approved projects generally go through loan processing faster.
8. Amenities and Specifications: Get the amenity list and specifications in writing. Brochure images are indicative and are not a substitute for the agreement.
After possession: Ask for the Occupancy Certificate, the society formation details and the handover of common documents. RERA makes the promoter responsible for structural defects reported within five years of possession.

Should I sign the Agreement for Sale before paying the booking amount?
A developer cannot take more than 10% of the cost as advance without a registered Agreement for Sale. Read the draft agreement before you pay a significant booking amount and keep every receipt.
Can I ask for the title report?
Yes. The title search report is part of the project's public MahaRERA disclosures, and you can ask the developer for a copy. Consider having your own advocate review it.
